It’s not a violation of the Migratory Bird Treaty Act to destroy a nest if it doesn’t contain eggs or young. It’s done all of the time without permits and it’s what U.S. Fish and Wildlife Services encourages to avoid having to do interventions when eggs or young are present. State law is more difficult to interpret because it says it’s illegal to “maliciously” destroy the nest of Protected Wildlife so you have to meet that standard of maliciousness.
